1. Acceptance of Terms

By downloading, installing, or using Nodly (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.

Age Requirement: You must be at least 13 years old to use Nodly. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

Binding Agreement: These Terms constitute a legally binding agreement between you and samko labs, s.r.o. ("we", "us", "our").

2. Description of Service

2.1 What Nodly Provides

Nodly is an iOS application that suggests creative activities based on your available time, participants, mood, and materials. The App provides:

Activity recommendations tailored to your preferences
Step-by-step instructions for creative projects
A personal creation history to track completed activities
Optional photo attachments to save memories

2.2 No Guarantee of Suitability or Safety

Important: Nodly provides activity suggestions "as is" without any guarantee that they are suitable or safe for all users, situations, or skill levels.

Activities may involve physical materials, tools, or actions that could pose risks
We do not verify the safety of activities for specific age groups, abilities, or environments
You are solely responsible for assessing whether an activity is appropriate and safe for you or those under your supervision

3. User Obligations

3.1 Responsible Use

You agree to:

Use the App only for lawful purposes
Not misuse or abuse the App or its services
Assess the safety and suitability of any activity before attempting it
Supervise children at all times when they are using the App or doing activities suggested by the App
Use appropriate safety equipment and precautions as needed for physical activities

3.2 Parental Supervision

If you are a parent or guardian allowing a child to use Nodly:

You are responsible for supervising the child's use of the App
You are responsible for supervising the child during any physical activities
You must assess whether suggested activities are age-appropriate and safe for the child
You assume all risks associated with the child's use of the App and participation in activities

3.3 Prohibited Conduct

You agree not to:

Attempt to gain unauthorized access to our servers or systems
Use the App in any way that could harm, disable, or impair our services
Reverse engineer, decompile, or disassemble the App
Use automated tools to access the App (bots, scrapers, etc.)
Upload or transmit viruses, malware, or harmful code
Violate any applicable laws or regulations

The Nodly App, including all content, features, design, code, and functionality, is owned by samko labs, s.r.o. and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

4.2 Activity Content

Activity instructions, descriptions, and materials lists provided by the App may be:

Original content created by us
Inspired by common creative practices and public domain ideas
Licensed from third-party sources

We do not claim ownership of generic craft techniques or publicly known activity ideas.

4.3 User-Generated Content (Photos)

When you upload photos to the App:

You retain all ownership rights to your photos
You grant us a worldwide, non-exclusive, royalty-free license to store, display, and process your photos solely for the purpose of providing the App's services to you
You represent that you have the right to upload the photos and that they do not violate any third-party rights
We do not use your photos for marketing, advertising, or any purpose other than displaying them to you in your creation history

You can delete your photos at any time by deleting creations or deleting your account.

5. Disclaimers

5.1 "AS IS" and "AS AVAILABLE"

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Accuracy - We do not warrant that activity instructions are accurate, complete, or error-free
Safety - We do not warrant that activities are safe for any particular user or situation
Results - We do not warrant that you will achieve any particular outcome from following activity instructions
Availability - We do not warrant that the App will be uninterrupted, timely, or free from errors

5.2 No Professional Advice

Nodly is not a substitute for professional advice. Do not rely on the App for:

Medical, safety, or health advice
Educational or developmental assessments
Professional supervision or instruction

Always consult qualified professionals when appropriate.

5.3 Third-Party Content and Links

The App may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or availability of such third-party resources.

6. Limitation of Liability

6.1 Injuries and Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

Personal injuries, property damage, or other harm resulting from activities suggested by the App
Injuries or harm to children under your supervision
Allergic reactions, accidents, or mishaps during activities
Damage to property or materials
Lost or deleted creation data or photos
Service interruptions or technical failures

YOU ASSUME ALL RISKS associated with using the App and attempting any activities.

6.2 EU Consumer Law

For EU/UK Users: Nothing in these Terms limits your statutory rights under EU or UK consumer protection laws. We cannot exclude or limit liability for:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Any other liability that cannot be excluded by law

Subject to the above, our total liability for any claims arising from these Terms or the App is limited to the amount you paid us in the 12 months prior to the claim (which, for a free app, is zero).

7. Account Termination

7.1 Your Right to Terminate

You may stop using the App at any time and delete your account using the "Delete Account & Data" button in the app settings. This will:

Delete all your creations from our servers
Delete any photos you uploaded
Remove your device identifier and all associated data
Sign you out of the App

7.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if:

You violate these Terms
You engage in abusive, harmful, or illegal conduct
We discontinue the App or service

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms are governed by the laws of Slovakia and the European Union, without regard to conflict of law principles.

8.2 Jurisdiction

Any disputes arising from these Terms or the App shall be resolved in the courts of Slovakia. However, if you are a consumer in the EU/UK, you may also bring proceedings in your local courts as permitted by EU consumer protection laws.

8.3 Informal Resolution

Before filing any legal claim, please contact us at samo@vrablik.eu to attempt informal resolution. We are committed to resolving disputes fairly and quickly.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements.

Effective Date: Changes are effective as of the "Last Updated" date at the top of this document.

Notification: We will notify you of material changes by:

Updating the "Last Updated" date
Displaying an in-app notification (if appropriate)

Your Continued Use: Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

By using Nodly, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
